Service Agreement

Fine Print:

When the staff arrives at the event, they will be paid the full price in cash in an envelope (if it is the first time you have used EPPH.). Otherwise, we will be paid in advance by Venmo or Paypal. At the end of the event, we expect a gratuity between 18% to 30%%. You will decide on the quality of our service, or price of food, or the cost of the bar.

The following service agreement is for catering special events and staffing parties that cost over $1,000.

Catering, staffing, Service Agreements:

We set up catering and event planner agreements on paper as well as online. As for our staffing, we do online confirmation agreements, unless it is a staff of over 8 staff members.

This catering services agreement (the "Agreement") is dated:

THIS CATERING SERVICES AGREEMENT IS BETWEEN:

BACKGROUND

Event & Party Professionals Hawaii has 20 years of experience and has references upon request.

EPPH Catering company is agreeable to providing such services to the Customer on the terms and conditions set out in this Agreement.

In Consideration of the matters described above and of the mutual benefits and obligations acknowledged, the Customer and the Caterer (individually the "Party" and collectively the "Parties" to this Agreement) agree as follows:

Services Provided

The customer hereby agrees to engage the Caterer to provide the customer with services ("the Services") consisting of: (fill in)

The services will also include any other tasks which the Parties may agree on. The Caterer hereby agrees to provide such Services to the Customer.

Terms of Agreement

The terms of this Agreement (the "Term") will begin on the date of this Agreement and will remain full force and effect until the completion of the Services, subject to earlier termination as provided in this Agreement. The Terms of this Agreement may be extended by mutual written agreement of the Parties

Performance

The parties agree to do everything necessary to ensure that the terms of this agreement will remain in full force and effect.

Currency

Except as otherwise provided in this Agreement

Compensation

For the services rendered by the Caterer of $(fill in) by total or per hour.

Half of the Compensation will be payable at the signing of the agreement. and the other half will be payable at the arrival of event staff at the beginning of thof the event. Gratuities for staff will be given at the end of the event preferably in cash (*18% to 35%)

Deposit

A deposit of (fill in) USD (US Dollars) (the "Deposit") will be payable by the Customer on or (fill In) before for the event planner, or staff will be payable by the customer on or before Date:

Cancellation

The deadline for the Customer to cancel this event without penalty is 3 weeks prior (the "Cancellation Date"). The following penalties will apply where the Customer cancels the event at any time after the Cancellation

Return of Property

Upon the expiry or termination of this Agreement, the Caterer will return to the Customer any property, documentation, records, or confidential information that is the customer's property.

Capacity/Independent Contractor In providing the Services under this Agreement it is expressly agreed that the Caterer is acting as an independent contractor and not as an employee. The Caterer and the Customer acknowledge that this Agreement does not create a partnership or joint venture between them and is exclusively a service contract.

Notice

All notices, requests, demands, or other communications required or permitted by the terms of this Agreement will be given in writing and delivered to the Parties of this Agreement as follows:

Modification of Agreement

Any amendment or modification of this Agreement or additional obligation assumed by either Party in connection with this Agreement will only be binding if evidenced in writing signed by each Party or an authorized representative of each Party.

Time of the Essence

Time is of the essence in this Agreement. No extension or variation of this Agreement will operate as a waiver of this provision.

Assignment

It is agreed that there is no representation, warranty, collateral agreement, or condition affecting this Agreement except as expressly provided in this Agreement.

Governing Law

It is the intention of the Parties to this Agreement that this Agreement, be construed by and governed, to the exclusion of the law of any other forum, by laws of the state of Hawaii, without regard to the jurisdiction in which any action or special proceeding may be instituted.

Severability

If any of the provisions of this Agreement are held to be invalid and enforceable with the invalid or unenforceable in whole or in part, all other provisions will nevertheless continue to be valid and enforceable with the invalid or unenforceable severed from the remainder of this Agreement.

Waiver

The waiver by either Party of a breach, default, delay, or omission of any of the provisions of this Agreement by the other Party will not be construed as a waiver of any subsequent breach of the same or other provisions.
